Terms & Conditions
These terms set out the agreement between you and Construction Training Group Cyf (trading as Construction Training Group) for NVQ assessment, NPORS training and testing, and related services. Please read them before you book. Completing and submitting our registration form means you accept these terms; acceptance does not depend on payment being made.
1. Who we are
Construction Training Group Cyf, a company registered in England & Wales, company number 15451449.
- Registered office: recorded on the public register at Companies House. We are opening a new office and will publish the address here as soon as it is in use. For anything in writing, email us — that is a valid written notice for every purpose in these pages.
- Email: info@ctg.org.uk
- Telephone: 01244 722697
- VAT: we are not registered for VAT, so no VAT is charged on our fees and none is recoverable on them.
“We”, “us” and “our” mean Construction Training Group Cyf. “You” means the person or organisation booking with us. “Learner” means the person receiving the training or assessment, who may not be the same as you.
2. Consumers and business customers
Some of these terms apply differently depending on whether you are a consumer or a business customer.
- You are a consumer if you are buying for yourself, wholly or mainly outside your trade, business, craft or profession.
- You are a business customer if you are buying in the course of a business — for example an employer enrolling its workforce.
Where a clause applies only to one group, it says so. Nothing in these terms affects a consumer’s statutory rights under the Consumer Rights Act 2015 or the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.
3. What we provide
NVQ qualifications. We are an approved centre delivering competence-based qualifications on behalf of awarding organisations including GQA Qualifications and NPORS. NVQs are assessed entirely in your workplace via a remote e-portfolio, nationwide. There are no exams and no classroom attendance.
NPORS training and testing. Plant and machinery training and testing to NPORS standards, delivered on site or at an agreed venue.
We provide assessment and administration. We do not award qualifications and we do not issue CSCS cards — see clause 10.
4. Booking and when a contract is formed
Completing and submitting our registration form is your acceptance of these terms. That is the point of acceptance, whether you pay at the time, pay later, or are invoiced through an employer.
Your order is an offer to buy from us. A contract is formed only when we send you a written booking confirmation by email. If we cannot accept your order we will tell you and will not charge you.
We may decline a booking where the learner does not meet the eligibility requirements of the qualification, where we do not have capacity, or where a price has been listed in error.
Please check your booking confirmation carefully and tell us straight away if anything is wrong.
5. Price and payment
Prices are those shown on our website or in your written quotation at the time of booking. Prices are the total you pay. We are not registered for VAT, so no VAT is added at checkout and no VAT is recoverable on our fees.
Our published NVQ fees are:
- Level 1 — £250
- Level 2 — £750
- Level 3 — £950
- Level 4 — £1,200
- Level 5 — £1,350
- Level 6 — £1,300
- Level 7 — £1,400
NPORS fees are quoted per category and confirmed in writing before booking.
We accept debit and credit card, Apple Pay, Google Pay, Link, Amazon Pay, PayPal and bank transfer. Card payments are processed by Stripe; we never see or store your full card details.
We do not offer buy-now-pay-later or instalment credit of any kind. Fees are payable in full at the time of booking, or against an approved purchase order for business customers.
Where you are a business customer paying against a purchase order, our invoices are payable within 30 days. We may charge statutory interest and compensation on late payment under the Late Payment of Commercial Debts (Interest) Act 1998.
6. Your right to cancel — consumers
If you are a consumer buying online, by phone or by email, you have a legal right to cancel within 14 days of the day we send your booking confirmation, without giving a reason.
If you ask us to start within the 14 days. Assessment and training normally take longer than 14 days to arrange, so if you want to get going straight away we will ask you to confirm that in writing. You keep your right to cancel, but we may charge you a proportionate amount for the service actually provided up to the point you cancel — including any awarding-body registration fee we have already paid on your behalf, which we cannot recover.
You lose the right to cancel only once the service has been fully performed, and only where you gave express prior consent to us starting and acknowledged that you would lose the right on completion.
How to cancel, what you get back and when: see our Refund & Cancellation Policy, which forms part of these terms and contains the model cancellation form.
7. Cancelling, postponing or transferring — business customers
Clause 6 does not apply to business customers. Instead:
- NVQ registrations may be cancelled before we register the learner with the awarding body, for a full refund less our £50 administration charge.
- Once the learner is registered with the awarding body, the £140 registration fee and our £50 administration charge are non-refundable.
- Booked NPORS training or test dates may be postponed or cancelled on the notice periods and charges set out in your written booking confirmation. Non-attendance on the day is charged in full, because the trainer, machine and test slot are committed.
- You may substitute a different learner on a booked NPORS date at no charge, provided the replacement meets the eligibility requirements and we have their details in time to complete registration before the course begins.
8. Cancellation by us
We may cancel or reschedule a booking where there are too few learners, where an assessor or trainer is unavailable, where a site is unsafe, or for another reason outside our control. We will offer you an alternative date or a full refund of amounts paid for the cancelled element. We are not liable for travel, accommodation or lost-time costs, except where you are a consumer and the loss was a foreseeable result of our breach.
9. What we need from you
Assessment cannot proceed without your cooperation. You (or the learner) must:
- give us accurate information, including proof of identity and, where required, a National Insurance number so a Unique Learner Number can be obtained;
- be working in, or have access to, a relevant workplace so that competence can be evidenced;
- supply workplace evidence, photographs, witness testimony and completed units within the timescales agreed with your assessor;
- tell us about any support needs or reasonable adjustments as early as possible;
- provide a safe working environment for any assessor or trainer attending your site, and comply with health and safety law.
Inactive registrations. If a learner stops submitting evidence and does not respond to their assessor, we will write to them at the address we hold. If there is still no response after a reasonable further period, we may treat the registration as withdrawn. Fees paid are not refundable in that event, and restarting will require a new registration and fee. We will write to you before we do this.
Registration period. Awarding-body registrations are time-limited. The period that applies to your qualification is set by the awarding organisation and is confirmed in your enrolment paperwork. If the qualification is not completed within that period, a re-registration fee may apply.
10. Assessment, certification and CSCS cards
Assessment decisions are made against the awarding body’s published standards and are subject to internal and external quality assurance. We cannot guarantee that any learner will achieve a qualification — that depends on the evidence produced meeting the standard.
Certificates are issued by the awarding organisation, not by us, and we are not responsible for delays in their processing.
CSCS cards are separate. CSCS is an independent scheme. Applications are made by the learner directly to CSCS after certification, are subject to CSCS’s own requirements including the CITB Health, Safety and Environment test, and carry their own fee. Achieving an NVQ does not automatically entitle anyone to a card, and we have no control over CSCS decisions or timescales.
If you disagree with an assessment decision, you can challenge it — contact us using the details on our Complaints & Whistleblowing page and we will send you our appeals procedure and register your appeal.
11. CITB grant funding
CITB grants are administered by CITB, not by us. Where a grant is available it is paid to the employer, and only where that employer is registered with CITB, is in scope of the levy and is up to date with its levy returns. We will tell you what a qualification is worth in grant and support your claim, but we cannot guarantee that CITB will pay it, and your fee remains payable in full whether or not a grant is received.
12. Intellectual property
Course materials, assessment templates and content on this website belong to us or our licensors. You may use them for your own training and assessment. You may not copy, resell or distribute them, or use them to deliver training to others, without our written permission.
Evidence a learner produces remains theirs, but by submitting it you licence us and the awarding body to hold, review and quality-assure it for as long as our regulatory obligations require.
13. Our liability to you
We never exclude or limit liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else it would be unlawful for us to exclude.
If you are a consumer: we are responsible for loss you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. We are not responsible for unforeseeable loss, or for loss arising from your own failure to provide evidence or information. Your statutory rights to a repeat performance or price reduction under the Consumer Rights Act 2015 are unaffected.
If you are a business customer: we are not liable for loss of profit, loss of business, business interruption, loss of contracts or any indirect or consequential loss. Our total liability arising out of or in connection with a booking is limited to the fees you have paid us for that booking.
We are not liable for the acts, decisions or delays of awarding organisations, CSCS or CITB.
14. Complaints and appeals
If something goes wrong, tell us — our three-stage procedure and our whistleblowing route are set out on the Complaints & Whistleblowing page. Complaints about service quality and appeals against assessment decisions are handled separately; if you are not satisfied with our final response you can escalate to the relevant awarding organisation.
15. Your personal data
We handle personal data in line with UK GDPR and the Data Protection Act 2018. What we collect, why, who we share it with and how long we keep it is set out in our Privacy Policy.
16. Events outside our control
We are not liable for failure to perform caused by something beyond our reasonable control, including severe weather, industrial action, failure of utilities or transport networks, epidemic, or the act of a public authority. We will contact you as soon as possible and, where the delay is substantial, you may cancel and receive a refund for services not provided.
17. Changes to these terms
We may update these terms. The version that applies to your booking is the one published when you placed your order, and we will keep dated copies. Material changes affecting an existing booking will be notified to you in writing.
18. Other important terms
We may transfer our rights and obligations under these terms to another organisation, and will tell you in writing if we do. You may only transfer your rights or obligations with our written consent. This contract is between you and us; no other person has any right to enforce it.
If any provision is found to be unlawful, the rest continue in force. If we delay in enforcing a term, that does not prevent us enforcing it later.
19. Governing law
These terms are governed by the law of England and Wales, and the courts of England and Wales have exclusive jurisdiction. If you are a consumer living in Scotland or Northern Ireland, you may also bring proceedings in your own country’s courts.
